Arch Coal <br />Company is one of the surface owners of the disturbed azea that has been proposed for Phase One <br />release. Due to the significant snow cover at the Beaz No. 3 Mine reclaimed area, the Division is <br />postponing the Phase One bond release field inspection until late spring or eazly summer of 2004. Rule <br />3.03.2(2) requires that a bond release field inspection be performed only when the reclamation work <br />can be properly evaluated by the Division. The Rule further states that there may be seasonal <br />limitations on the timing of the field inspection. This postponement is necessary because the snow <br />cover will prevent a proper evaluation of the reclamation results.
