Pridemore: <br />On July I5, l998 the Division of SvSinerals and Geology conducted an inspection of your operation and found that the <br />existine 55,000.00 Financial Warranty was insufficient to fulfill [he requirements of the reclamation plan so the Division <br />determined an adequate Financial Warranty requirement and notiFed the Operator of the additional amount. The Operator <br />was allowed up to 60 days to post the additional Financial Warranty. The Operator failed to post the additional Financial <br />Wartanry within the allowed 60 day period. <br />We believe this is in violation oFC.R.S. 34-32.5-I 17(4)(6) and (c) for failure to post additional Financial Wartanry within <br />b0 days from the date of written notice. <br />Therefore, we have reason to believe that a violation exists to Permit Number NI-84-043 and to the Law, and have <br />scheduled this matter before the Mined Land Reciama:ior, Board. <br />A Formal Public Hearing will be held dunne the June 23-24; 1999 Board meeting for consideration of possible vtolation. <br />The hearing will be held to Rocm 3 i8 of 1313 She-mart Street, Denver, Colorado, beginning ar9:00 a.m or as soon <br />thereafter as the matter can be considered. At that hearing you will have the opportunity to be represented and heard. <br />It will be reiterated that there is reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist order, assess a Civil Penalty in the amount <br />of S 100.00 to 51,000.00 For each day of violation, or order the. permit be suspended, modified, or revoked. [n addition <br />it may set the matter for consideration of forfeiture of the 55,000.00 financial wartanty a[ a subsequent hearing.
