<br />Battle Mountain Gold <br />NOPV Abatement Requirements <br />page 3 <br />(B) Amendment of Tailings Area Reclamation Plan: <br />The Division is concerned that the introduction of cyanide in 'o the <br />tailings area may be indicative of the inclusion of associate metallic <br />contaminants not originally anticipated in its approved opera ions and <br />reclamation plan. BMG's preliminary suspicions of altered metallic ore <br />content, and the coincidental failure of the designed processing cyanide <br />recovery circuit, are additional indications of a modification in the <br />tailings chemical constituency. If the chemical constituency f the <br />tailings is different than the original projections, the proje ted <br />characterization of the tailings as non-toxic and chemical ine t is <br />suspect. Change in the tailings constituency may render the approved <br />final reclamation plan for the tailings inappropriate. <br />In light of any information developed by BMG in the course of hts <br />required investigations, analyses and redesign, including any bmendment <br />to its processing methodology, BMG shall amend its tailings ar a <br />detoxification and reclamation plans appropriately. Appropria a permit <br />amendments, supported by comprehensive analytical results and esign <br />evaluations, shall be submitted by BMG to the Division for revfiew and <br />approval no later than 90 days following completion of the cya ide <br />detoxification of the tailings areas contents, described in it m (4) <br />above. <br />(9) Amendment of Environmental Monitoring Plan: <br />BMG shall amend its environmental monitoring plan to include d rect <br />monitoring of the cyanide and metals content of the tailings s urry and <br />liquids. Within 15 days following the cyanide detoxification f the <br />tailings area contents, described in item (4), BMG shall submi sampling <br />methodology, sampling locations and sampling protocol for tail ngs <br />cyanide and metals content monitoring to the Divison for revie and <br />approval. <br />Further, BMG shall appropriately amendment its <br />monitoring plan, including ground and surface <br />circuit monitoring, to reflect all amendments <br />with these NOPV abatement requirements. These <br />in connection with the various amendments. <br />(10) Amendment of Financial Assurance: <br />entire environm ntal <br />water, air, and rocessing <br />completed in com liance <br />amendments shal submitted <br />As required by statute and regulation, any permit amendment or ,revision <br />approval will entail reevaluation of the cost of the entailed eclamation <br />components. BMG will be required to appropriate amend its sur ty to <br />reflect any increased reclamation cost. Any amendment or reviuion <br />application submitted by BMG shall include an appropriate evaluation of <br />the implications of the requested plan modifications for the reclamation <br />cost. <br />
