In the Memorandum you rey~est a series of <br />changes be made to the Agreement in order to satisfy the concerns of the Slate of Montana <br />which stem from an exisan; contractual rclarionship with RCG/Hagler, Bally, Inc. While <br />we remain uncertain as to the basis of such concerns, we nevertheless harte attempted to <br />develop a constructive response to your Memorandum as follows: <br />1. The title of the Agreement will be modified to "Agreement forlEnvironmental <br />Sampling Services". <br />2. RCG/Hagler, Bailly, Inc. will be : eferred to as "Contractor" throughout the <br />Agreement. <br />3, Paragraph 1.1, Line 1 will reflex: the requested modification of the word <br />"professional" to "sampling". <br />4, The following language will be added to the end of Paragtaph 1, 1: <br />"Notwithstanding any other provisions of this agreement, it ifi <br />understood that the services to be provided under thi$ <br />a Bement are limited to the w""'°"" collactio <br />gr ..~> ~ <br />preservation and shipment of samples, and reporting on the <br />laboratory results 1aF:a"saticc;Wnt~:~*~~`v Contractor <br />shall not provide expert consultation on any other mallet <br />relating to the site or otherwise." <br />
