Rule 1.6,.5.(2) Proofofpublication notice circulated in local newspaper (TIMES CALL) and all owners <br />of record that are within 200 feet of the boundry of the affected and permitted land. These are included <br />in the packet and are idendified as # 1. <br />2. Rule 6.4.3. Exhibit C- Pre-Minutg and Mining Plan Map(s) of Affected Lands. This rule ~equ'ves the <br />following information to be located on the map. <br />• Rule 6.3.3.(a) requires that immediate adjacent surface owners be identified on a map. <br />• Adjacent owners map enclosed identified as item # 2(a) <br />• Rule 6.3.3,(b) requires a map identifying all creeks ,roads , buildings ,power and communication lines on <br />the area of affected land and is shown for all permitted land within 200' of all boandries. Enclosed is a large <br />colored map showing all these things. This is identified as item 2(b). This map will be used in several <br />exhibits. There are no buildings or structures included in the defined area. 1 suggest in the future that the <br />county advise any future land owners of this 200' boundry around otu permitted area and that no buildings or <br />structures such as garages ,houses or wells etc. be developed in that zone. This area was all pre-mined , pre- <br />disturbed when we bought it 29 years ago; we plan to reclaim all areas that we have disturbed in our 1 I O <br />permit and probably will reclaim other areas as time allows. Some pre-disurbed areas have already reclaimed <br />• themselves with the development of trees and foliage during this interim. <br />Rule 6.3.3.(d) requves a map to show the total areas to be mined and the total area to be affected. The large <br />colored map shows the areas we are now mining, the fines and top soil areas, roads, work decks that are <br />cwnposed of fines, stone and lop soil to be used for reclamation. It also shows the staging or processing areas <br />in It green. The light blue shows the working area in the #2 area where rocks were pushed over the edge and <br />the developing ofthe quarry there. We commit to no[ pushing any more rocks into the canyon, but agree with <br />the findings of the Board that to make a road down the canyon to pick up the few rocks that went astray <br />during the operting of that quarry would cause more damage than leaving it as it is, and we will bring up the <br />rocks that we can and revegeta.te it as soon as it is suitable. We apologize for that happening ,however ,we <br />had hired an outside contractor to do that. Neil was not there all ofthe time to supervise him and he seemed <br />to get a kick out of seeing the racks roll down the hill. We are however responsible far anything that happens <br />on our land so will do the best we can to resolve that as time permits us to do so. We do not at this time have <br />many large areas of rip-rap or waste rock because it has been incorporatred into the work decks. th order to <br />comply with the requirements of MSHA ,we must have either a three ft. berm on the edge where the road goes <br />around the corner or we must put large rocks there to prevent anyone from running the'v car over the edge. <br />We have chosen to put the large rocks there as that is the most practical resolution at this time. We will hire <br />an excavator to accomplish the pulling up of the rocks and top soil that are over the edge as as soon as it <br />can be scheduled <br />
