n <br />U <br />-3- <br />NOTICE OF VIOLATION <br />n <br />Based upon the Findings of Fact and in accordance with C.R.S. 34-32-124(6), <br />the Colorado Mined Land Reclamation Board hereby finds Mr. Earl Lawrence <br />d.b.a. Lawrence Construction Company to be in violation of Permit no. 74-41 <br />specifically Exhibits C, D, E, and G and C.R.S. 34-32-116(1)(8) and (h). <br />CEASE AND DESIST ORDER <br />AND <br />ORDER TO PAY CIVIL PENALTIES <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Mr. Earl Lawrence d.b.a. Lawrence Construction <br />Company to: <br />1. Cease and desist all mining operations at the Lawrence Pit - Permit No. <br />74-41. <br />2. Submit an acceptable amendment and/or technical revision correcting the <br />violations to be approved by the Board at or before the September 24-25, 1985 <br />Board Meeting. In the iterim, corrective action in the nature of seeding the <br />topsoil stockpile, adjustments to the settling ponds and removal of material <br />from the existing stockpiles can be undertaken. <br />3. Pay the Colorado Mined Land Reclamation Division a civil penalty in the <br />amount of $3,000.00 for the violations, within 30 days of the signature of <br />this document. This is based upon an assessment of $1,000.00 per day for 6 <br />days of violation from May 16 to May 22, 1985 or $6,000.00 of which $3,000.00 <br />would be suspended provided Mr. Lawrence submits an amendment or technical <br />revision which is approved by the Board at or before the September 25-26, 1985 <br />Board Meeting. <br />4. In the event Mr. Lawrence fails to submit an amendment or technical <br />revision that is approved by the Board at or before the September 25-26, 1985 <br />Board meeting, Mr. Lawrence must pay the Colorado Mined Land Reclamation <br />Division the remaining $3,000.00 civil penalty. <br />5. Mail, within one (1} day after receipt of this Notice, to the Mined <br />Land Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />
