n U -3- NOTICE OF VIOLATION n Based upon the Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds Mr. Earl Lawrence d.b.a. Lawrence Construction Company to be in violation of Permit no. 74-41 specifically Exhibits C, D, E, and G and C.R.S. 34-32-116(1)(8) and (h). CEASE AND DESIST ORDER AND ORDER TO PAY CIVIL PENALTIES Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2) and (7) the Colorado Mined Land Reclamation Board hereby orders Mr. Earl Lawrence d.b.a. Lawrence Construction Company to: 1. Cease and desist all mining operations at the Lawrence Pit - Permit No. 74-41. 2. Submit an acceptable amendment and/or technical revision correcting the violations to be approved by the Board at or before the September 24-25, 1985 Board Meeting. In the iterim, corrective action in the nature of seeding the topsoil stockpile, adjustments to the settling ponds and removal of material from the existing stockpiles can be undertaken. 3. Pay the Colorado Mined Land Reclamation Division a civil penalty in the amount of $3,000.00 for the violations, within 30 days of the signature of this document. This is based upon an assessment of $1,000.00 per day for 6 days of violation from May 16 to May 22, 1985 or $6,000.00 of which $3,000.00 would be suspended provided Mr. Lawrence submits an amendment or technical revision which is approved by the Board at or before the September 25-26, 1985 Board Meeting. 4. In the event Mr. Lawrence fails to submit an amendment or technical revision that is approved by the Board at or before the September 25-26, 1985 Board meeting, Mr. Lawrence must pay the Colorado Mined Land Reclamation Division the remaining $3,000.00 civil penalty. 5. Mail, within one (1} day after receipt of this Notice, to the Mined Land Reclamation Board, written notice of your compliance with paragraph one (1) of this Cease and Desist Order.
