<br />Condition No 2 - stormwater Mana¢emen[ <br />DMG will require that [he operator submit within 45 days an application ror a technical <br />revision which provides appropriate stormwater runoff calculations, engineering designs and <br />plans, as well as all necessary approvals for the conveyance of stormwater from the <br />Tezak Quarry across Tunnel Drive to the Arkansas River without causing adverse of(site <br />impacts. The revision application must also ensure that all designed structures will be <br />installed and functioning properly no later than March 30, 1996. The revision application <br />must include written approvals from the city of Canon Ciry, the Hydraulic Duch Company, <br />and [he Southern Pacific Railroad. <br />Condition No. 3 <br />The Division will require the operator to notice the objectors and all appropriate parties for <br />each revision to the amended permit and also provide a copy of each revision application for <br />review at the County Clerk and Recorders office in Canon Ciry. <br />Condition No. 4 <br />The Division will require the operator to Cease and Desist from any disturbance in the <br />amendment area until the operator has successfully demonstrated compl lance vrith conditions <br />1, 2, and 3, has received Division approval of an acceptable plan for safely routing <br />stormwater offsite to the Arkansas River, and has completed installation or all approved <br />stormwater designs, including ditches, ponds, spillways, culverts, and other structures as <br />necessary. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult C.R.S. 24-4-106, <br />as amended. <br />~Z <br />Dated at Denver this ~~ day of <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
