Therefore, I would <br />appreciate a response from you on or before September 29, 2000. Any public comments that we <br />receive on your application during the interim will be forwazded to you. Please be advised that <br />your conversion application may be deemed inadequate and may be denied on October 17, 2000 <br />unless the following adequacy review items are addressed to the satisfaction of the Division. <br />EXHIBIT D -MINING PLAN <br />1. As required by Rule 6.4.4(d), please clarify the maximum disturbance to be expected at any <br />one time. (ie, should the site be bonded for a total disturbance of 21 acres or should the <br />reclamation cost be based on a maximum disturbance to be expected at any one time). <br />EXHIBIT E -RECLAMATION PLAN <br />2. As required by Rule 6.4.5(2)(f)(ii), please specify (provide) the recommended seed mixes from <br />the NRSC that will be used for permanent reclamation to cropland and for temporary seeding of <br />topsoil stockpiles. <br />3. Based on the Division's 8/10/2000 pre-operation site inspection, it appears that there may be <br />yellow toadflax present within the 21 acre permit area. Since yellow toadflax is listed as being a <br />noxious weed in Colorado and since Rule 3.1.10(6) requires that methods of weed control shall <br />be employed for all prohibited noxious weed species, the Division requests that the applicant <br />include in the reclamation plan specific methods of weed control that will be implemented for <br />
