Long Division Director The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, Pazagraph 3, of the Colorado Revised Statutes, that on March 4, 2002, an application to renew an existing permit to conduct coal mining operations at the King Coal Mine Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. National King Coal, LLC proposes to continue underground coal mining and/or reclamation operations on [and located approximately 7 miles southwest of Hesperus, Colorado. The permit area is further described as follows: All or Portions of Sections 28, 29, 31, 32, T35N, R11W, NMPM; Portions of Sections S and 6, T34N, Rl l W; Portions of Sections 36, T35N, R12W. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Hesperus. This is the fourth renewal of National King Coal's permit to conduct coal mining operation at its present location. Because the above referenced permit renewal application would incorporate additional lands into the permit area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy offish and wildlife resources information, the fish and wildlife plan, and the reclamation plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered species, are requested. If wildlife habitat is the proposed postmining land use, we request your evaluation of proposed woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse impacts. Applicable sections of the pemrit renewal are enclosed.
