Long <br />Division Director <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Pazagraph 3, of the Colorado Revised Statutes, that on March 4, 2002, an application to renew <br />an existing permit to conduct coal mining operations at the King Coal Mine Mine was considered complete <br />for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining <br />Reclamation Act and the Rules initiate from this date of filing. <br />National King Coal, LLC proposes to continue underground coal mining and/or reclamation operations on <br />[and located approximately 7 miles southwest of Hesperus, Colorado. The permit area is further described <br />as follows: <br />All or Portions of Sections 28, 29, 31, 32, T35N, R11W, NMPM; Portions of Sections S and 6, T34N, <br />Rl l W; Portions of Sections 36, T35N, R12W. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Hesperus. <br />This is the fourth renewal of National King Coal's permit to conduct coal mining operation at its present <br />location. <br />Because the above referenced permit renewal application would incorporate additional lands into the permit <br />area or might otherwise alter previously approved permit conditions or mitigation measures, we are <br />requesting your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy <br />offish and wildlife resources information, the fish and wildlife plan, and the reclamation plan as it relates to <br />fish and wildlife considerations, including potential impacts to threatened or endangered species, are <br />requested. If wildlife habitat is the proposed postmining land use, we request your evaluation of proposed <br />woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse <br />impacts. <br />Applicable sections of the pemrit renewal are enclosed. A copy of the renewal application is available for <br />public inspection at the La Plata County Courthouse, 1060 E Second Ave, Durango, CO 81301, and at the <br />Division office, Room 215, 1313 Sherman Street, Denver, Colorado 80203, (303) 866-3567. <br />
