~~ ~ • • <br />III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On July 'L5, 1991 the Division conducted a complete inspection at <br />the Somerset mine. Present at the inspection was Basil Bear and <br />Bill Percharich of Somerset Mining Company. At the time of the <br />inspection the weather was partly cloudy. <br />The Railroad is continuing to work on the railroad relocation. <br />The new railroad bed is now up to final grade. Still to be <br />completed is the placement of the ballast, track laying and <br />switching from the old track to the new. Once the transfer is <br />made the old railroad grade will be removed. Construction of the <br />conveyor and access road alignment is continuing. Workers were <br />pouring footers for the conveyor. A large culvert had been placed <br />under the access road to Elk Creek. This culvert is about 6 feet <br />in diameter and will allow the conveyor to pass under the road. <br />At the face-tip area for the Sanborn Creek Operation 3 entries <br />were being driven. In the center entry a continuous miner was <br />actively mining coal and workers were constructing the reinforced <br />entryway. Work had progressed to about 10 feet into the coal. <br />Next to the entry there was a small temporary pile of oxidized <br />coal and a larger pile of saleable coal. In the center entry, <br />workers were constructing reinforced archway. The entry would <br />extend about 30 feet out from the face-up and would be buried <br />with earth. This would serve to protect workers from falling <br />rocks from the vertical highwall. <br />Construction of the sediment pond for the Sanborn Creek operation <br />is continuing. Work cannot be completed until the old railroad <br />grade is removed. Presently the railroad grade serves as a berm <br />for sediment control. <br />The inspection continued to the Elk Creek facilities area. <br />Ditches and culverts were clear; ponds were dry and appeared to <br />be in good condition. Sediment control along the haul road <br />appeared to be in good condition. Filter fences were intact and <br />working. <br />The reclaimed ventilation fan area at Bear Creek was inspected. <br />Roads and sediment control were working effectively at this site. <br />The inspection continued at the <br />checked. During the records check <br />1. The NPDES permit expired <br />was a letter on file from th <br />extension to the existing <br />issued. <br />shop area where records were <br />the following were noted: <br />March 31, 1990, however there <br />D.O.H. that gave an indefinite <br />permit until a new permit is <br />2.
