The language in the restrictions needs to be stronger to <br />prevent abuses. <br />Mr. Houtz was primarily concerned about the plant's hours and <br />days of operation, and echoed Mr. Fciedley's comments about the <br />need for more monitoring of the operation. Mr. Houtz also <br />requested more prompt action on complaints of violations reported <br />by neighbors. <br />After extended debate centering on compliance and hours of <br />operation, Commissioner Baty suggested that condition 10 be revised <br />to read: <br />"Normal hours of operation shall be limited to 7 A.M. to 6 <br />P.M., Mondays thcough Saturdays except when there exists an <br />extraordinary and unusual hardship condition, caused by more <br />than 1 day of bad weather or equipment breakdown in that week. <br />Sixteen-hour operation, 5 A.M. to 9 P.M. and Sunday operation <br />more than four Sundays per year shall follow the neighborhood <br />notification procedure outlined in Mr. Gosney's 11/5/92 <br />letter. The Gravel crusher shall not be operated on Sundays <br />unless a hardship situation is created by equipment breakdown <br />or bad weather of one or more days in the week prior." <br />Commissioner Baty moved that Project Number 93-191 be approved <br />subject to the following conditions suggested by Staff and amended <br />by the Board: <br />1. That all verbal, graphic and written representations of <br />the applicant are deemed conditions of approval. <br />2. in the event that a court of competent jurisdiction in an <br />action brought by the Applicant shall find that any <br />condition of approval of any permit shall be invalid for <br />any reason, it is the declared intent of the Board of <br />County Commissioners that the entire permit shall then <br />become void, and the underlying land use unlawful and <br />prohibited pending a new application approval. <br />3. That the Applicant install the accel/decel lanes per the <br />requirements of the County Engineer. <br />4. That the Applicant implement the Wildlife Mitigation Plan <br />to the greatest extent practicable. <br />5. That the Applicant stockpile gravel between the gravel <br />crusher and the adjoining neighbors to the greatest <br />extent practicable. <br />6.
