Long <br /> <br />FROM: <br />Erica Crosb <br />~~/ Division Dueaor <br /> y <br />RE: Colowyo Coal Mine (C-81-019) <br /> Pattern of Violations <br />Rules 5.03.3(2)(b) and (c) of the Rules and Regulations require that the Division Director <br />promptly review the history of violations of any permittee who has been cited for violations <br />during three or more inspections of the permit area within any twelve month period. The <br />review is to determine whether a pattern of violations exists or has existed, and, if a pattern <br />exists, whether we will require the operator to show cause why the permit should not be <br />revoked or suspended. <br />Colowyo Coal Company L.P. was issued three notices of violation during three separate <br />inspections of the Colowyo Coal Mine. The citations, in brief, were: <br />May 24. 1994 Inspection <br />NOV C-94-013 Failure to pass disturbed area drainage through a sedimentation <br />pond or treatment facility before leaving the permit area. <br />Failure to construct sediment treatment facility, specifically a <br />disturbed area diversion, prior to disturbing an undisturbed <br />area. Failure to construct a diversion to prevent additional <br />contributions of suspended solids to runoff outside the permit <br />area. Specifically, topsoil removal operations began prior to <br />having all sediment control diversions constructed. <br />July 14. 1994 Inspection <br />NOV C-94-037 Failure to provide sufficient information regarding the <br />characteristics of the West Pit mining area sediment control <br />practices to demonstrate adequate capacity to contain or treat <br />runoff from a 10-year, 24-hour precipitation event. <br />
