~ ~ III IIIIIIIIIIIII III
STATE OF COLORADO
;;
Roy Romer, Governor
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON, Dlreetor
February 17, 1987
Mr. Rick Mills
Colorado Yampa Coal Company
29588 Routt County Road No. 27
Oak Creek, Colorado 80467
Re: Partial Bond Release Request, Eckman Park, Mine Nos. 1 and 2, File No.
C-81-071
Dear Mr. Mills:
We have received the above noted partial bond release request. Publication of
the release request can commence at any time. Rule 3.03.2(2) requires the
Division to conduct a bond release request within 30 days of the request for
release or as soon thereafter as weather conditions permit. Due to current
snow cover and potential for adverse weather conditions, the bond release
inspection will not be conducted until May or June, 1987. Notification will
be provided to the OSM and surface owners, and they may accompany the Division
on the inspection.
As you are aware, the Division is required to review the bond prior to issuing
a proposed decision on the pending renewal. The most recent bond review prior
to the renewal was initiated during the mid-term review and a bond amount of
X10,499,000.00 was determined. Since no release has occurred since that time,
and disturbance has not occurred as rapidly as projected, the Division will
evaluate the bond based on the worst case assumptions identified at that
time. A maintenance bond will be included for the older re vegetated areas.
The Division determined during the summer of 1986 that certain areas had not
been regraded in compliance with the approved plan. Asa result, a notice of
violation was issued and subsequently a revision to modify the backfilling and
grading plan was submitted. That revision is currently under review by the
Division. The revision may ultimately result in significant modification of
the currently approved backfilling and grading plan, and bonding level.
However, the bonding review which we will conduct for permit renewal will not
be based on proposals contained within the revision application.
Please contact me if you have any questions.
Sincere]I ~f/ t
( ~
Dan T. athews
Reclamation Specialist
DTM/v j r
7516E
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel. 1303) 866-3567
