Publication of <br />the release request can commence at any time. Rule 3.03.2(2) requires the <br />Division to conduct a bond release request within 30 days of the request for <br />release or as soon thereafter as weather conditions permit. Due to current <br />snow cover and potential for adverse weather conditions, the bond release <br />inspection will not be conducted until May or June, 1987. Notification will <br />be provided to the OSM and surface owners, and they may accompany the Division <br />on the inspection. <br />As you are aware, the Division is required to review the bond prior to issuing <br />a proposed decision on the pending renewal. The most recent bond review prior <br />to the renewal was initiated during the mid-term review and a bond amount of <br />X10,499,000.00 was determined. Since no release has occurred since that time, <br />and disturbance has not occurred as rapidly as projected, the Division will <br />evaluate the bond based on the worst case assumptions identified at that <br />time. A maintenance bond will be included for the older re vegetated areas. <br />The Division determined during the summer of 1986 that certain areas had not <br />been regraded in compliance with the approved plan. Asa result, a notice of <br />violation was issued and subsequently a revision to modify the backfilling and <br />grading plan was submitted. That revision is currently under review by the <br />Division.
