Please ensure that copies of this letter and attachments aze <br />also distributed to the Board members. <br />1) As noted in the "Synopsis of Events" (SOE), a backfilled, and previously <br />revegeta[ed slope on the northwest side of the central quarry had failed. Due to weather <br />problems, stabilization of this failed slope was not completed until approximately 12-20-92, with <br />heavy dozer work implemented to not cause further failure. This was accomplished in the time <br />frame allowed by the DMG. Final grading was completed in June, 1993 as also allowed by the <br />DMG. Hydroseedinglmulching iscurrently underway. With only two companies able to do this <br />kind of work, to my knowledge, in the azea, they have also been extremely busy and could not <br />do this work until now. <br />2) On 10-16-92, Cooley contacted the DMG for advice on how to proceed with our <br />mine plan, on file with the DMG, to correct failing bedrock highwalls on the east side of our <br />quarry. Tension cracks had developed approximately 80 feet to the east of the maximum limit <br />of approved Major Disturbance. Highwalls and benches were failing westward into the quarry. <br />Subsequently, MSHA inspected the area of failure and placed the quarry under citation to berm <br />off the failing area so that personnel would not be working below. The citation has since been <br />rescinded as long as work (mining} is not occurring on or below the failing area. No mining <br />has occurred on or under the failing area since 10-15-92, nor will mining occur in this area until <br />approval to do so is received. <br />On 10-23-92 we requested emergency/administrative approval to correct the failing area, <br />requiring mining further east from the current limit, from both the DMG and Jefferson County. <br />Both M-C zoning (through the county) and the DMG permit boundary limit is approximately 700 <br />feet to the east.
