We respectively request that the issue of stability of the Minnesota Reservoir be looked at very
carefully and studied, before West Elk is allowed to continue with this present proposed mining
of the "E" seam in close proximity to the Reservoir. We would like to see West Elk share in the
liability concerning the people and property downstream if the dam should fail. There are 173
shareholders in this Reservoir, some use it for there livelihood. All need the water, it is a
valuable resource.
We, the Board of the Minnesota Canal and Reservoir Co. Inc. we would like to be included in all
future meetings dealing with the matter of this expansion.
Cc : James G. Norfleet, P.E., State Dam Safety Engineer
Phil Schmidt, West Elk Mine
Michael McCarthy, Attorney-at-Law
Sincerely,
Minnesota Canal and Reservoir Co. Inc
Rnarrl of TlirPrtnrc
