<br />adding acreage to the permit area and, since 110 amendments are not <br />allowed by the Mined Land Reclamation Act, a replacement <br />application is necessary. I will admit that I indicated an <br />"amendment" was a possibility in my inspection report when it <br />really was not. I should have known better; the staff had been <br />advised that 110 permits could only be amended under the <br />Construction Materials Act. The process of amending a 110 permit or <br />replacing it, however, is very much the same. <br />Please advise as to how you want to proceed with this proposal. Do <br />you want to withdraw it now that the Division cannot accept it as <br />a technical revision or do you want the Division to formally deny <br />it.
