adding acreage to the permit area and, since 110 amendments are not
allowed by the Mined Land Reclamation Act, a replacement
application is necessary. I will admit that I indicated an
"amendment" was a possibility in my inspection report when it
really was not. I should have known better; the staff had been
advised that 110 permits could only be amended under the
Construction Materials Act. The process of amending a 110 permit or
replacing it, however, is very much the same.
Please advise as to how you want to proceed with this proposal. Do
you want to withdraw it now that the Division cannot accept it as
a technical revision or do you want the Division to formally deny
it. I have included a new application form and Performance Warranty
form for your use if Summit Brick still wants to pursue adding
acreage to the reduced permit area, as I believe they should.
Please contact me if you have any questions on the above.
Sincerely,
,. `a.vv~ C s'~u~u~
James C. Stevens
Sr. Specialist
Enclosures
96NO174
