Batavia Dr. <br />Aurora, Colorado 80011 <br />RE: Freund Pit, 112(c) Permit, Permit No. M-1985-003; Withdrawal of Reason to Believe a <br />Violation Exists and Notice of Re-inspection <br />Dear Mr. Freund, <br />This correspondence is in reference to the Reason to Believe (RTB) letters that were sent to you <br />by the Division of Reclamation, Mining and Safety on January 11, 2007. These letters explain <br />that, as a result of the findings during an inspection conducted on March 23, 2006, there were <br />continued problems at this permit site. As of the date these RTB letters were sent out, these <br />problems remained «nresolved. <br />At this time, the Division has made the determination to withdraw this matter from consideration <br />by the Mined Land Reclamation Board. In addition, due to personnel changes at the Division, <br />this permit has been reassigned to a different specialist. The operator will be contacted by Deb <br />Gonima (303-866-4179) to schedule a time to re-inspect this site within 60 days of the date of <br />this letter. <br />It is highly recommended that the operator resolve the issues detailed below to the satisfaction of <br />the Division prior to this re-inspection. <br />The issues remaining and resolution recommendations are as follows: <br />1. Issue: Affected area within the mine pemtit boundaries was not well-mazked - in possible <br />violation of Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for the Extraction of Construction Materials (Rule 3.1.12(2): "The boundaries of <br />the affected area will be mazked by monuments or other markers that are cleazly visible <br />and adequate to delineate such boundaries.") <br />a.
