("MPC") Notice of Violation
MV-2001-041, Howe Pit, Permit No. M-78-052
Dear Tom:
This letter follows up my November 20, 2001 letter to you requesting, on
behalf of this firm's client, Mobile Premix Concrete, Inc. ("MPC"), an extension of
time to submit a Revised Drainage Control Plan as specified in Section 2.A of the
Mined Land Reclamation Board's Order of October 26, 2001. It also follows up
on my telephone call to you on Monday, November 26, 2001. Please find
attached a copy of the plans presented to the UDFCD Task Force earlier this
afternoon. The attached plans are predicated on MPC's acquisition of an
easement over the McIntosh property to convey Bull Seep and storm drainage
flows to the South Platte River through the Bull Seep Slough.
This submittal, along with that of November 20, should be sufficient to
secure the requested extension of time. Please call to confirm the Division's
agreement to the extension.
Thank you.
Sincerely yours,
Jeffrey W. Schwarz
Attachment
