Subsequently, on Monday, <br />Octaber 19, 1992, we were inspected by an MSHA team due to the <br />above concern. Pursuant to that inspection, MSHA mandated that <br />we reduce the highwall slopes within a short time frame, in order <br />to mitigate a potentially life threatening situation. <br />Due to the nature of this emergency we are requesting that we be <br />allowed, through your administrative decision, to increase the <br />outer limits of our excavated slopes to the east, by as much as <br />200'. This is well within our permit boundary. The approval of <br />this increased limit of excavation will not alter the visual <br />impact of the Quarry to the residents east of us. The urgency of <br />this situation requires an answer from MLRD by October 28, 1992. <br />We are concurrently seeking approval from Jefferson County, and <br />because of the emergency nature of our request, expect immediate <br />approval. We fully understand the need for an amendment to our <br />mine plan in order to fulfill the regulatory requirement of an <br />increase in the mining boundary within the permit area. We will <br />be more than happy to comply with an amendment subsequent to an <br />administrative decision to approve the new limit of excavation <br />for this emergency situation. The amendment would include <br />highwall, bench, and backfill specifications both in plan and <br />profile, and other documentation if required. <br />Prior to Wednesday, October 28, we would welcome a site tour by <br />the Division staff, so that the new limit of excavation can be <br />physically observed within the Quarry. <br />
