Cottony <br />Acting Division Director <br />The Division has reviewed yow submittal of September 9, 2002, which was in response to ow Preliminary <br />Adequacy Review (PAR) letter of August 1, 2002. In general, the submittal package included thorough <br />and comprehensive design modifications and clarifications that adequately addressed the deficiencies <br />identified in the August 1 PAR letter. <br />The only specific adequacy comments we have aze the following (numbered to correspond to the numbered <br />items in the response submittal): <br />2. There appeazs to be a typo in the new wording in the first sentence of the fourth pazagraph of amended <br />page 2.2-12. Rule 4.04.2 was referenced, but the correct reference would be 4.05.2. Please amend <br />the page to provide the correct regulatory reference. <br />3. Text on page 2.2-12i was revised to state that the pond is basically a dugout pond, with little if any <br />embankment. No further amendment is requested at this time, however if the constructed pond <br />does have an embankment, the as-built drawing will need to reflect this change from the design <br />drawing. <br />9. Rule 4.05.18(1) regliires that no land within 100 feet of an ephemeral stream with a drainage azea <br />greater than one squaze mile, shall be disturbed by mining operations unless the Division specifically <br />authorizes operations closer to, or through such a stream upon fmding: <br />a) That swface coal mining operations will not cause or contribute to the violation of applicable <br />water quality standazds; and <br />b) That dwing and after mining, the water quantity and quality, and other environmental resowces of <br />the stream shall not be adversely affected. <br />The applicant has provided information within the text and figwes of the amended application <br />documenting that Munger Creek within the permit area is an ephemeral stream with a drainage azea <br />greater than one squaze mile, and that the distwbance associated with the refuse pile is within 100 feet <br />of the stream channel. <br />The applicant has also provided design and narrative information affuming and documenting that <br />operational and reclamation practices, and drainage and sediment control measwes will be sufficient to <br />enswe compliance with relevant provisions 4.05.18(1)(x) and (b).
