According to this a-mail, the discharge occurred as a <br />result of a broken thickener underflow discharge line that allowed coal fines to flow into Twentymile <br />Coal Company's Sedimentation Pond E, then out of the pond's primary spillway and into the creek. <br />In response to your report, we are hereby directing Twentymile Coal Company to immediately take the <br />following measures: <br />Assess and contain all potential toxicity impacts to Foidel Creek and Trout Creek. This includes <br />sampling Sedimentation Pond E, Foidel Creek, and Trout Creek for the presence of any potential <br />toxic thickener constituents, and includes immediately repairing the thickener line. Provide us <br />with documentation of the chemical constituency of the discharge material. <br />2. Notify all downstream water owners and users, from the point where the discharge entered <br />Foidel Creek to the confluence of Trout Creek with the Yampa River, of this event. <br />3. Continue sampling Sedimentation Pond E and Foidel Creek to verify compliance with CPDS <br />effluent limitations and WQCC receiving stream standards. <br />4. Notify the Colorado Division of Wildlife of this event. Implement directions from CDOW <br />necessary to address any potential impacts to aquatic life in Foidel Creek and Trout Creek. <br />5. Re-establish all DRMS-approved sediment control systems. <br />Once these immediate impact abatement measures are achieved, please submit plans for abatement of <br />any potential long-term impacts that may be necessary. <br />Office of Office of <br />Mined Land Reclamation AQive and Inactive Mines <br />
