financial records, but the accountant had neglected the records, so the Respondent retained a new <br />accountant that is now preparing [he necessary information. Respondent expects to be able to submit the <br />necessary information to the surety so that the financial warranty may be increased within the next two <br />weeks. <br />8. The Respondent has failed to increase its financial warranty within 60 days of the date of the Division's <br />notice, thereby violating C.R.S. 34-32.5-117(4)(c)(II). <br />ORDER <br />Based on the above findings of fact and conclusions of law, the Board orders that Respondent shall: <br />A) Cease and desist from any further mining activities at [he site, except for reclamation activities <br />as specified in the approved reclamation plan, until Respondent complies with the remainder of <br />this Order; <br />B) No later than August 31, 2002, either submit and receive Division approval of the required <br />financial warranty, or conduct sufficient reclamation work at [he site, as specified in the <br />approved reclamation plan, to reduce the reclamation liability at the site so the existing financial <br />warranty is adequate to cover remaining reclamation liability; <br />C) Pay a penalty of $9,900.00, with al] but $300.00 suspended, provided that the Respondent <br />complies with the foregoing corrective action. <br />DATED this 3~ day of ~'~'t"'~' '~ ` , 2002. <br />FO COLORADO MINEDLAND RECLAMATION BOARD <br />~" / <br />Ronald W.
