The fourth option is: if stockpiling at this site is desired, for periods of more than 180 days, certain criteria
additional to those set forth in the preceding paragraph must be met. These changes will be submitted by the
operator as part of a technical revision or amendment, addressing the addition of the stockpile area as affected land
and detailing the facility. It will be reviewed by the Division for its compliance with the statutes and rules listed in
this letter.
At this time, the operator is cautioned that any future use of unpermitted land, which has not been properly prepared
for stockpiling ore or protecting water resources or other lands against adverse impact, may be in violation of his
permit and the Act, and such practices must cease.
The operator is reminded that he is the permitted operator of the Ute Ule Mine and Mill site (permit no. M-1978-
092), which has an approved ore stockpile area and is approved for receiving ore material from the Golden Wonder
Mine. Though it is not as conveniently located,'it is suggested that this alternative approved and permitted location
be considered for the interim or long-term, as a fifth option.
Please respond to this letter with your stated commitment to cease all stockpiling at Vickers Ranch, or your
commitment to temporarily cease which must be accompanied by an expressed intention to file for a technical
revision or amendment. I would like to have your statement of response within 90 days of the date of this letter.
If you do not agree with this assessment of how your operation is governed by the Rules, you may request a hearing
before the Mined Land Reclamation Board for consideration of your appeal.
If you have questions or comments, I may be reached at the Division's Durango field office: 701 Camino del Rio,
Room 125, Durango, CO 81301; phone 970/247-5193 or fax 9 70724 7-5 1 04.
Sincerely,
~~~ C~~.~
Bob Oswald
Environmental Protection Specialist
cc: Kye Abraham, LKA International, Inc.
a:\gwm ore/rco
