Long <br />Division Director <br />FAXED to Lorencito Coal Co. and Buckley Powder Co. <br />October 29, 2001 <br />At 8:00 a.m., October 29, 2001, I spoke with you and James Phillips, Certified <br />Surface Blaster in Colorado, regarding supervision of blasting activities at the <br />Lorencito Canyon Mine, Las Animas County, Colorado. Mr. Phillips is a Certified <br />Surface Blaster in Colorado in good standing and will begin supervising activites <br />today. A faxed letter from you indicated Mr. Phillips will supervise blasting <br />activities at the mine until November 3, 2001. <br />Based upon this development, this is notice that you roay resume blasting operations <br />at the Lorencito Canyon Mine, which confirms my verbal approval this morning. <br />This lifting of the cease and desist order on blasting operations is contingent upon <br />either Mr. Phillips or such other Colorado Certified Surface Blaster is on site and <br />actively supervising all phases of blasting operations at the mine. <br />William C.
