Tltc leak is <br />apparently the result of ongoing and continuing suhaidcttce caused from Rasln <br />Resource's coal mining operation. <br />Denttutd is hereby made that Basin Resources take immediate Ineasures in <br />conjunction with the cooperalioll of tllc Talurrt's to repair t11is leak, altd return the <br />properly to its pre-auhsidcnce condilioll. <br />The City of Trinidad has not afforded us much time to repair the leak, ]f not <br />promptly repaired Iltc City of Trinidad will tam off the water to ortr holnc rendering it <br />itnposslble for us to maintain our home and care for our livestock. <br />The instant ln•oblcllt was addressed during the original cilir.elts complaint tiled itl <br />1993 and the civil trial. Tht: "siltk hole" was viewed by DMG, OSM, altd }3asilt during <br />the initial investigation. "fltis is an ongoing subsidence issue. <br />Mr. Henry Austin with OSM bccante aware of the ongoing damage +Ind dtlritig <br />his inspection of tllc property rnt September 22, 2000. Mr. Ron Thompson with 13asitt <br />Resources, ]nc. was made aware of Olc ongoing damage on Seplelnher 22, 2000. To dale <br />Basin Resources, ]nc. tress made no attempt to repair Uto damage created by tfteir mining <br />operations. <br />Tlris is our formal notice of complaint against Basin licsources, [lte. for <br />subsidence damage to our home and property. <br />
