October 18, 2000 <br />Basin Resources, Inc. <br />3800 County Road 63.9 <br />Trinidad, CO 81082 <br />Golden Eagle Mine, C-81-013 <br />Citizen complaint CC 00-140-003 <br />Ten Day Notice 00-140- 116-002 <br />This Mine Site Evaluation Inspection Report (MSEII2) is intended as an administrative action to issue Ten <br />Day Notice (TDN) 00-140-1 16-002, violation 1 of 1, which transmits the above citizen complaint (copy <br />enclosed) to the State of Colorado, Division of Minerals and Geology (DMG). The citizen complaint was <br />received by the Office of Surface Mining (OSM), Western Regional Coordinating Center (WRCC), Denver <br />Field Division (DFD), via fax from the complainant on October 16, 2000. <br />The allegation in the complaint gives OSM a reason to believe that if true, the allegation constitutes a <br />violation of DMG's approved regulatory program at Rule 4.20.3 (2) a, b, & c. The complainant alleges: <br />"...the water problem in the meadow south of our home is from a leak in the city line running through our <br />property. The leak is apparently the result of ongoing and continuing subsidence caused from Basin <br />Resource's coal mining operation." <br />The City of Trinidad has been notified of this water leak and aze awaze of the location. OSM recommends <br />that Basin Resources, Inc., or any party initiating repairs on the water line, notify the Trinidad City <br />Department of Water prior to, and at the conclusion of repairs. <br />Please address any questions concerning this inspection report or TDN to Henry Austin at <br />haustin@osmre.eov or (303) 844-1400 X1466. <br />
