>~ ~. <br />•' •- <br /> <br />LAND STABILIZATION <br />AND RECLAidATIGN AGREEMEi7T C+,.~l. ~n::_._.'.'_`. .....:_ <br />THIS AG^n,EEtdENT is entered into this 2 ~/ day of ,Su w~ , <br />1974 by and between THE STA.E CF COLORADO, by and through its Director of <br />2latural Resources and the Lard Reclamation Board (hereinafter referred to <br />as "State") and PASQUALE VA.'S?, d.b.a. VARRA ENTERPRISES (hereinafter <br />referred to as "Varra"). <br />W I T N E S S E T H: <br />WHEREAS, Varra desires to operate a sand and gravel mine in <br />Section 31, T3N, R67W, Weld County, Colorado; and <br />WHEREAS, Varra has submitted a plan on the Proposed Land <br />Stabilization and Reclamation Procedures for the proposed sand and gravel <br />mine operations; and <br />WHEREAS, said sand and gravel mine will be operated for the <br />pu_^pose of extracting sand gravel for commercial marketing; and <br />WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br />statutory authority for the Land Reclamation Board of the State of <br />Colorado to enter into agreements with operators or persons in charge <br />of mining operations such as those contemplated by Varra to insure that <br />the necessary stabilization and reclamation work will be done to prevent <br />landslides, floods or erosion. This section of the law further provides <br />that the Land Reclamation Board requires a performance bond conditioned <br />upon the faithful performance of the stabilization work required by the <br />Board; and <br />WHEREAS, the Land Reclamation Board has determined that the <br />mining operation to be conducted by Varra in said Section 31 could have <br />ar. adverse affect on the environment and could result in landslides or <br />erosion if proper stabilization and reclamation procedures are not <br />fol_owed. <br />NOW THEREFORE, pursuant to the authority set forth in the <br />Cclorado Open Mining Land Reclamation Act, the Land Reclamation Board <br />of the State of Colorado has determined that the following land <br />
