Varna Companies, Inc. seeks release of the above permit and <br />related financial and performance warranties. Support for this request is as follows: <br />- Originally permitted at 1311 acres under a `Land Stabilization and Reclamation <br />Agreement' on 24 June 1974, the operation was converted to a Regular (112) Permit <br />on 5 December 1980, with Recreation as the approved end use. <br />- The operation was Amended in 1985 and 1992. The 1985 Amendment changed the <br />end use to Agriculture. Both the 1985 and 1992 Amendments (1 and 2 respectively) <br />were released by the Division on 26 November 2003; leaving the balance of the <br />original 1311 acre permit. <br />- Of the remaining 1311 acre permit area, 10t acres of a coal ash study area was <br />released by the Division on 28 January 2002, as described in correspondence and a <br />related map from DMG's Harry Posey of that date; leaving a balance of 1211 acres <br />remaining to be released. The 10t acres released by the Division was subsequently <br />released by the Colorado Department of Health, as indicated in the attached <br />correspondence from CDH. <br />- Of the 1211 remaining acres, the Colorado Division of Water Resources released the <br />single remaining pond as 53t acres {53.0764) of 'Pre-law' water, which does not <br />require augmentation. The balance of exposed water on the site was backfilled under <br />an approved Backfill Permit, as part of a Technical Revision approved by the Division <br />on 3 September 1996. <br />A The southeast comer of the quarter section south of St. Vrain Creek is operated <br />exclusively by Patina Oil and Duke Energy, with an attending reclamation agreement <br />with the landowner. This portion of the permit area was not affected by the operator. <br />A The approved permit called for revegetation along the perimeters of any ponds. A <br />durable cover of native vegetation, predominantly wheatgrass, exists along the <br />remaining pond. The balance of surrounding lands are graded to 3H:1V or flatter and <br />seeded. Vegetation establishment varies based upon the seeding date, intervals and <br />existing land uses. <br />- Since the operator is also the landowner, the site is currently being used under <br />agricultural rules established by Weld County, Colorado, including the construction of a <br />Residence, a Recreational Home, a storage area for valuable materials, and related <br />outbuildings, consistent with agricultural properties throughout Weld County, Colorado. <br />The existing shop area on the extreme NW comer of the property was never inGuded <br />NoV-/1~oN~ <br />
