-2- <br />C. Backfillina and grading of the portal bench, the guard trailer <br />bench and the affected drainage segment between the upper bench and <br />the lower facilities area will be conducted in compliance with the <br />approved plan contained in permit C-87-072 and as further detailed <br />in a letter dated February 5, 1990 from Mr. Dan Matnews, of the <br />Division to Mr. W.D. Lamoreux, of the Bank (Attachment 2), Unless <br />an acceptable alternative plan is submitted by the Bank and <br />approved by the Division, portal and trailer bench backfill <br />material will be spread in 24 inch lifts and compacted to 90e of <br />maximum dry density. The steep sided drainage segment extending up <br />from the lower or facilities bench to the base of the backfilled <br />portal bench will be graded to a uniform gradient, with abrupt <br />slope transitions and pads asspClated with conveyor supports <br />eliminated. Backfillina and grading of the portal bench, guard <br />trailer bench and drainage se_ament will be initiated no later than <br />July 1, 1990 and completed no later than September 1, 1990. <br />D. Backfillina of portal access and light use roads, topsoilina of the <br />lower bench, backfilling of acid treatment ponds, leach pads and <br />septic tank excavation, sealing of three drill holes and <br />revegetation of the entire disturbed area will be conducted in <br />compliance with the approved plan contained in permit C-87-072 and <br />further details specified in the previously referenced <br />December 1, 1989 letter (Attachment 1) and a letter of <br />December 15, 1989 from Mr. Dan Mathews of the Division to <br />Mr. W.D. Lamoreux of the Bank (Attachment 31. These activities <br />will be initiated no later than September 15, 1990 and completed no <br />later than October 15, 1990. <br />E. The existing sediment pond on Mr. Tony Sarver's property to the <br />south of County Road 120 will be reclaimed in compliance with the <br />approved reclamation plan contained in permit C-87-072 no later <br />than October 15, 1990. The bank will submit to the Division no <br />later nan une _90 an acceptable alternative sediment control <br />plan addressing a ovation and design of sediment check dams, <br />berms, ditches and other structures to be installed north of the <br />county road. The alternative sediment control plan will be <br />implemented by the Bank prior to removal of the existing sediment <br />pond. <br />F. Upon successful completion of the reclamation plan in compliance <br />with this Letter of Agreement, the Bank will 6e eligible to seek <br />bond release in conformance with the requirements of Rule 3.03. <br />The Bank will be responsible for performing necessary maintenance <br />and repairs at the site during the bond liability period. <br />G. Reclamation tasks and timetables specified in this Letter of <br />Agreement will be strictly adhered to unless specific revisions <br />are requested, in writing, by the Bank and approved, in writing, by <br />the Division. <br />
