The NOVs
concern surface owner notification (NOV C-93-1121, topsoil consolidation (NOV C-93-
113), and light use roads (NOV C-93-114).
At present, Mountain Coal Company believes that these NOVs should be vacated.
Mountain Coal Company is, however, having some difficulty collecting documentation
concerning the facts underlying the NOVs. This difficulty is especially acute for the
NOV arising from surface owner notifications, which involves events that occurred
nine years ago. Mountain Coal Company therefore requests permission to have until
September 7, 1993 to submit to you a letter explaining why these NOVs should be
vacated.
Thank you for considering this request. Mountain Coal Company looks forward to
discussing these NOVs with you in greater detail.
Sincerely,
Scot W.
