Long <br />Division Direc mr <br />Notice of Violation C-96-010 was issued to Powderhorn Coal Company <br />on May 1, 1996 for "Failure to minimize disturbance to the <br />hydrologic balance" and "Failure to operate and maintain facilities <br />to treat underground mine water discharges to meet effluent limits <br />in the mine's CPDS permit." <br />A water sample was collected by <br />discharge on March 28, 1996, because <br />The results of the analysis for Total <br />The permittee's CPDS permit limits <br />daily maximum of 70 mg/L. <br />the Division from the mine <br />of a brown, muddy appearance. <br />Suspended Solids was 84 mg/L. <br />Total Suspended Solids to a <br />The abatement steps for the NOV included 1) submitting a letter to <br />the Division describing what modifications would be made to the <br />underground water handling system to provide additional settling <br />time such that routing mine water to a sediment pond or treatment <br />facility will not be necessary, and 2) implementing the above plan. <br />The abatement deadlines were May 15, 1996 and May 29, 1996 for 1) <br />and 2), respectively. Step 1) of the abatement was completed on <br />May 14, 1996. The implementation of the plan had been nearly <br />accomplished (except for a pressure switch to activate the pump) at <br />the time the letter was received by the Division on May 14, 1996. <br />The operator had ordered the switch and expected to receive it by <br />the May 29, 1996 deadline. <br />Please let me know if you have any further questions. <br />
