Enforcement File <br />Susan Mowry ~ <br />Proposed Civil Penalty, NOV C-84-164 <br />This NOV was issued for failure to reclaim in a contemporaneous manner. <br />History - American Fuels, Inc. has been issued four NOV's in the past 12 <br />months - $200.00 <br />Seriousness - The failure to conduct reclamation activities in a <br />contemporaneous manner or to temporarily cease operations in <br />accordance with Rule 4.30 is a serious obstruction of the <br />Division's ability to enforce the Law. Therefore, this <br />component warrants the maximum penalty - $1,750.00 <br />Fault - The operator had been reminded of the need to comply with Rule 4.30 <br />if operations could not progress as normal. Despite these <br />reminders no steps were taken to submit the necessary documents or <br />recommence reclamation activity.
