C-84-062) <br />Permit Renewal Application Yo. 3 (RN-3) <br />Dear Sir or Madam: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on April 12, 1999, an application to renew an existing permit <br />to conduct coal mining opemtions at the Energy htitte No. 3 Mine was considered complete for the purposes of filing. <br />All review and comment periods as provided in [he Colorado Surface Mining Reclamation Act and [he Rules initiate <br />from this date of feline. <br />Colorado Yampa Coal Compan}• proposes to continue surface coal mining and/or reclamation operations on land <br />located approximately 10 miles southwest of Steamboat Springs, Colorad The permi[area is further described as <br />follows: <br />In Portions of Sections I, 2, 12, 13 and 24, TSN, R86W; and Sections 18 and 19, TSN, R85 W. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek. <br />Because the above referenced permit renewal application would incorporate additional lands into the permit area or <br />might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's <br />evaluation of the potential for impacts to threatened or endangered species of plants or animals, or wildlife species <br />otherwise protected by federal law. <br />[n order for us to approve this renewal, we are required to make a finding that "the activities would not affect the <br />continued existence of endangered orthreatened species or result in the destruction or adverse modification of [heir <br />critical habitats as determined under the Endangered Species Act of 1973...." We request your review and <br />recommendation pursuant to this finding. Applicable sections of the renewal application are enclosed. Please advise <br />us if you require additional information. <br />In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of <br />Minerals and Geology at the above address by on June I I, 1999. I f no comments are received by this date, we will <br />proceed on the assumption that your avency has no concerns with or objections to the applicant's proposal. <br />
