York-Feirn (OMLR). A report of this inspcaction <br />was received in the Cotter office September 15, 1994, which <br />indicated that the OMLR believed the mine was nonoperational, and <br />must apply for temporary cessation. Cotter has considered the <br />mine operational because of two factors: <br />1. Mine Safety and Health Administration consider:: the <br />mine as "Active Nonproducing", and has continued semi- <br />annual mine inspections. <br />2. Since 1989 the mine has continued to produce 100-200 <br />pounds of U30g monthly from mine water. <br />Not withstanding the foregoing, Cotter is requesting a <br />technical revision changing the Schwartzwalder status to an <br />intermittent operation in which the affected lands may be used <br />for less than 180 days per year (1.13.5(4)). <br />This request is pursuant to the OMLR recommendation in a <br />meeting with Cotter representatives on December 19, 1989. This <br />meeting was primarily related to bringing various Cotter mines <br />off temporary cessation, however, the guidelines establi:;had are <br />pertinent to the Schwartzwalder. Cotter has assembled for the <br />OMLR's review, and provides herein, information regarding the <br />operating status of the Schwartzwalder Mine. This information <br />supports a request for technical review of M-77-300 allowing for <br />periods of inactivity greater than 180 days. <br />
