GRAVEL PURCHASE AGREEMENT <br />Owner of Gravel <br />Purchaser of Gravel and <br />Permit Operator <br />August M. & Earlene I. I{rehmeyer <br />806 S. Burlington <br />Haxtun, CO <br />970-774-6201 <br />Ritcheys' Redi-Mix Concrete, Inc. <br />509 S. Idlewild St. <br />Yuma, CO <br />970.848-5451 <br />August M. & Earlene I. Krehmeyer, owner of the gravel in the proposed gravel pit <br />located in the SouW East quarter (SEI/4) of Section twenty-six (26), Township seven <br />(7), Range forty-seven(47), Phillips County, Colorado hereby agrees to sell gravel to <br />Ritcheys' Redi-Mix Concrete, Inc. <br />Ritcheys' Redi-Mix Concrete, Inc. hereby agrees to obtain a mining permit from the State <br />of Colorado and act as the operator of the pit. Ritcheys' Redi-Mix Concrete, Inc. further <br />hereby agrees to develop and adopt a reclamation plan in accordance with the State of <br />Colorado laws & regulations. <br />Gravel will betaken from the area in the permit described as the dry creek bed and <br />extended upon as needed hereby agreed to by both the owner and Ritcheys' Redi-Mix <br />Concrete, Inc. <br />Research indicates that surface ownership of this land and that the mineral rights are held <br />by August M. & Earlene I. ICrehmeyer. <br />Ritcheys' Redi-Mix Concrete, Inc. hereby agrees to pay $2.00 a yard for the gravel. <br />Payment will be made to August M. & Earlene I. ICrehmeyer, at the above address or at <br />their direction. This agreement is made for a period of ten (10) years and may be <br />extended by mutual agreement. <br />The property owner, August M. 8c Earlene I. ICrehmeyer, shall not be responsible for any <br />of the gravel pit operations. Ritcheys' Redi-Mix Concrete, Inc. assumes full liability for <br />those operations and is covered under their current liability policy for the gravel pit <br />operation. <br />This agreemem shall be binding on the heirs, successors and assigns of owner and <br />purchaser. <br />The signatures below by the owner of the gravel and Ritcheys' Redi-Mix Concrete, Inc. <br />signify acceptance of the conditions listed above. <br />Dated this iCc tday of September, 2005 at Haxtun, Colorado <br />
