Long <br />RE: Reason to Believe a Violation Exists, Exceeding the Amount of Affected Acreage Approved in°DfYie°° °"eCr°r <br />Minircg and Reclamation Permit, M-1988-044 Coa- Creek Resources <br />Dear Mr. Opheim: <br />On January 17, 2002 the Division of Minerals and Geology conducted an inspection of your operation and <br />found the following: There is a total of approximately 169 acres of disturbed land, including approximately <br />76 acres unreclaimed, that, therefore, exceeds the 60 acres of disturbance approved as a condition of the <br />permit. <br />We believe this is in violation of: the approved conditions of your permit, pursuant to C.R.S. 34-32.5-124(1). <br />Therefore, we have reason to believe that a violation exists to Permit Number M-1988-044 and to the Law, <br />and have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the Apri124 and 25, 2002 Board meeting for consideration of <br />possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 10:00 a.m. on Apri124th and 9:00 a.m. on Apri125th or as soon thereafter as the matter can be <br />considered. At that hearing you will have the opportunity to be represented and heard. It will be reiterated <br />that there is reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order and/or assess a Civil <br />Penaity in the amount of $ 100.00 to $1,000.00 for each day of violation.
