He said Meeker Sand and Gravel is owned by Mrs. <br />Conrado and himself as a corporation and that they would assume the <br />liability for the activity that has taken place on the property. <br />In response to an inquiry from the Board, Mr. Frank Johnson, Assistant <br />Attorney General, clarified that the Division reviews and approves <br />succession of operator applications, based on submittals from the <br />parties. <br />It was MOVED that the Board approve the Division's recommendations and <br />find the operator in violation for mining outside the permit boundary, <br />order corrective actions as suggested by the Staff and assess a civil <br />penalty at a rate of 550 per day (for good faith effort) for 14 days of <br />violation or 5700. SECONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, <br />Cooley, Jouflas, Stewart and Danni); Danielson and Cattany not present <br />for the vote. <br />Staff Presentation by Carl Mount: <br />15. Staff said BLM is also working with the <br />operators to produce a map which would be submitted with the operators' <br />application. Staff answered questions from the Board. <br />It was MOVED that the Board grant a continuance of this Item to the May <br />1992 Board Meeting.
