.. <br />defined role which does not include consideration of such disputes. <br />Issues raised by the objectors which fall within the jurisdiction <br />of the MLRB were fully considered by the MLRD in its adequacy <br />review. These issues are generally categorized and briefly <br />discussed in narratives which follow. <br />Mill and Tailings Facilitv Design <br />The CMLRD adequacy review included a detailed scrutiny of the <br />facility design and its capability to minimize disturbances to the <br />hydrologic balance. As discussed above, the mill and tailings <br />disposal facility are conservatively designed as non-discharging <br />structures with sufficient capacity to contain all drainage from <br />all foreseeable events including the PMP. The composite liner <br />system, the low moisture content and relative impermeability of the <br />deposited tailings and the generally inert nature of the tailings <br />solids result in a facility which can be reclaimed utilizing <br />conventional proven reclamation techniques with virtually no <br />potential for adverse water quality impacts to the surface or <br />groundwater resources. Battle Mountain's amendment application <br />material contains extensive technical documentation of these <br />conclusions and includes a monitoring plan and quality <br />assurance/quality control plan to verify the technical assumptions <br />inherent in the design and the predicted results. Under the <br />CMLRB's regulations the results of these plans are documents which <br />are available for public review. <br />8 <br />
