We believe that the <br />request is appropriate for the following reasons. The substantive abatement requirements <br />for the NOV required Somerset to submit a complete application by August 12 for a <br />technical revision to reclassify a road from an access road to a haul road and have such <br />application approved by October I1. Somerset made the required application but the final <br />abatement date was modified by your office until November 3, 1991 in order to <br />accommodate your desire to resolve issues during the October meeting of the Mined Land <br />Reclamation Board. On October 23, 1991 your office issued its proposed decision approving <br />the requested technical revision. As we understand the situation, an objection to the <br />approval of the technical revision has been received by your office and accordingly, final <br />approval for the technical revision cannot be accomplished by your office within the <br />modified abatement period. <br />Your regulations authorize the extension of abatement periods for a time frame exceeding <br />90 days under certai^ circumstances set forth in Rule 5.03.2(2)(c). We believe that the <br />circumstances summarized above fit squarely within the provisions of that regulation, <br />particularly sub-paragraph (i) which authorizes abatement period extensions where the <br />administrative approval requirements cannot be obtained within the ninety day time frame. <br />In this case the Somerset Mining Company has taken every step necessary to obtain such <br />approval but cannot because of circumstances beyond its control. This request contemplates <br />
