Shel ~ ,, LGG'~ <br />Enforcement File <br />RE: Pattern of Violation for Trinidad Basin Mining, Inc. <br />By memo dated August 21, 1984 from Mike Savage to Fred Banta and Brian Munson <br />transmitted to me on September 10, 1984 by Fred Banta, the coal staff of the <br />Mined Land Reclamation Division determined that a pattern of violation existed <br />at the Trinidad Basin Mining permit area. I have reviewed that memo and find <br />that the Cessation Orders are still under administrative appeal and thus, <br />cannot be counted toward a pattern of violation. The remaining six Notices of <br />Violation, however, constitute an unwarranted failure to comply and a pattern <br />of violation. Based on this pattern of violation, I am issuing a Show Cause <br />Order to Trinidad Basin Mining, Inc. as to why the permit should not be <br />suspended or revoked. It will be my recommendation to the Board that the <br />Mined Land Reclamation Board suspend that part of the permit which allows <br />Trinidad Basin Mining to continue to mine coal. The permit would remain in <br />force in regard to maintenance and reclamation requirements. <br />/mob <br />Doc.
