Since you propose to leave the wash <br />ponds for fishing ponds you must comply with Rule 3.1.5(7) regarding the sideslopes. If the entire area <br />along the Arkansas River (including the wash ponds) is going to be used for recreation, the reclamation <br />must include: replacement of growth medium, revegetation (the proposed seed mix is okay) and, <br />adequate grading of the pond slopes. The DOW would like to see more riparian vegetation (willows, etc) <br />in this area and may even contribute to the cost of reclaiming the site (as was discussed at the informal <br />conference). I assume the recreation area will be reclaimed at the end of all mining operations. Am I <br />correct? In addition, you must submit adequate documentation evidence to demonstrate compliance with <br />applicable Water laws since you propose to expose groundwater in the wash ponds. <br />As previously stated in my April 23, 1998 adequacy letter, "in those instances where [he post-mining <br />land use is for industrial/commercial purposes and such use is not reasonably assured, a plan for <br />revegetation shall be submitted. Appropriate evidence supporting such reasonable assurance shall be <br />submitted." Just stating that "Chaffee County has a shortage of industrially zoned land in which it is very <br />unlikely that some type of industrial activity will not occur upon this land" is not adequate evidence <br />supporting such reasonable assurance. The proposal you submitted, as well as the approved reclamation <br />plan in the existing permit, to revegetate the low sloped affected lands (pit floors and creosote area) will <br />be acceptable once you provide the Division with the following information: the thickness of screened <br />fines you propose to replace and the seed mix (if different from the proposed seed mix). <br />You mention using manure and mulch in the reclamation plan. The approved permit states that the <br />manure rate will be 20 tons per acre but does not specify a mulch rate or the type of mulch that will be <br />used. Please specify the type and rate of mulch you will use. <br />You state that "all former trash and refuse has been removed from the site." What about future <br />~~ accumulations of trash and refuse? Since this site is not being permitted as a landfill, you are not allowed <br />to accumulate trash and refuse. Frequent removal of trash and refuse will help keep the site clean. <br />Exhibit F -Rule 6.4.6 -You were asked to redo the reclamation plan map since you did not show the <br />proposed topography of the area with contour lines of sufficient detail to reflect the expected physical <br />appearance of the area. Once again, the revised maps you submitted do not show the expected physical <br />appearance of the area since you did not include any contour lines. Please revise the map in compliance <br />with this Rule. <br />Pursuant to C.R.S. 34-32.5-116(4)(q)(I), in part, "all reclamation requirements required by this section <br />shall be carried to completion with reasonable diligence and conducted concurrently with mining <br />operations to the extent practicable..." and that "final reclamation of each mining phase shall be <br />`l „ completed prior to the expiration of five (5) years after the date the operator advises the Board in an <br />annual report that such phase of mining has been completed.." You need to be aware of this five year <br />rule in your determination of what type of reclamation you must complete at the end of mining activities <br />in each phase. If an industrial use is assured, then the highwalls are the only areas that need to be <br />revegetated (pursuant to your proposal). If an industrial use is not assured, then the entire disturbed area <br />will have to be revegetated (again, pursuant to your proposal and the existing permit). Of course, the <br />recreation area will have to be revegetated. <br />Pursuant to Rule 1.8, you must file a copy of this letter and your response with the County Clerk and <br />,~ Recorder and provide the Division with an affidavit or receipt demonstrating that your response was filed <br />wi[h the Clerk and Recorder. <br />
