OSM is in agreement with the Proposed <br />Decision and hereby provides OSM concurrence to release Phase III <br />bond in accordance with 30 CFR 906.30(24). <br />The Colorado DMG conducted the Phase TI and Phase III bond <br />release inspection required at Colorado Rule 3.03.2(2) on <br />December 1, 1998. DMG's Proposed Decision documents the <br />inspection findings and indicates that all required public <br />notices and surface and mineral owner notifications were made in <br />a timely manner prior to the inspection. The ownershipHof the <br />land for which bond release has been requested is private, while <br />coal ownership was both private and_Federal. None of the <br />Federally-leased coal was~ever mined; the Federal lease has long <br />since been relinquished, and BLM no longer holds any lease bond. <br />The OSM Denver Field Division (DFD) participated in the bond <br />release inspection noted above, and inspection finci:ings are <br />documented in the OSM Mine-site Evaluation Reports dated <br />August 2, 1999. The U.S. Department of the Interior, Bureau of <br />Land Management (BLM) was notified of the inspection, but elected <br />not to participate. DFD received BLM's concurrence in a <br />telephone conversation dated August 2, 1999 (see attached <br />record). No other Federal land management agencies are involved <br />in this action. <br />United States Department of the Interior <br />No written objections or requests for informal conferences <br />regarding the proposed bond release were received by DMG. <br />
