Catlany
Division Director
Natural Resource Tms[ee
When DMG approved West Elk's Minor Revision No. 310 on July 20, 2005, the amount of estimated
reclamation liability was raised from $11,359,677 (the "Prior Liability" value) to $11,366,863 (the
"Revised Liability" value), an increase of $7,186 (the "Change in Liability" value). Our computerized
database should have then carried this new reclamation liability amount forwazd to the next permitting
action decision, which was a proposed decision for Technical Revision No. 100 (approved July 25,
2005). The "Revised Liability" value of $11,366,863 shown on the MR-310 decision form should
have thus shown up on the TR-100 proposed decision form as the "Prior Liability" value.
Unfortunately, this did not occur: the "Prior Liability" value on the TR-100 decision form was shown
as $11,359,677, a value that was $7,186 short of what it should have been. This $7,186 "shortage" was
unfortunately never corrected during subsequent permitting actions, being carried erroneously through
our proposed decision for Technical Revision No. 101 on September 9 2005.
We have corrected this error, and are supplying corrected permitting action decision forms for TRs 100
and 101 and MRs 313-316 for your files. The now-corrected estimated reclamation liability value is
$11,459,235. This is shown on the corrected TR-101 decision form as the "Revised Liability" value.
Please contact me at 303-866-4933 if you have any questions.
Sincerely,
~1yc^"'~""f ~ '
Daniel I.
