-2- <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 34-32-123, the Board hereby orders you to: <br />Immediately cease and desist all mining operations. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Submit a complete application for an appropriate mining permit to the <br />Division by July 26, 1992 and secure issuance of the permit by <br />September 24, 1992. <br />The Board also orders: <br />4. The matter of Civil Penalty shall be continued until the <br />August 26-27, 1992 meeting of the Board. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this 3rd day of June, 1992. <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICH,4EL B.
