Shelton <br />Director <br />November 24, 1982 <br />~~ ..._ <br />Mr. Tim Smith <br />Cotter Corporation <br />9305 West Alameda Parkway <br />Suite 201 <br />Lakewood, Colorado 80226 <br />RE: Swartzwalder Mine - File No. 77-300 Notice of Formal Hearing For <br />Board Consideration of Possible Violations <br />Dear Mr. Smith: <br />Pursuant to the authority vested in the Mined Land Reclamation Board ("MLRB") <br />pursuant to C.R.S. 1973, 34-32-124(1), the MLRD at its meeting of Noven~ber 18, <br />1982, at which your representative was present and did participate, after due <br />consideration did find reason to believe that certain provisions of permit <br />No. 77-300, issued to the above-referenced operation, have been violated. <br />The provisions alleged to have been violated are: <br />a) Exhibit A, concerning the temporary waste pile, of the application <br />approved by MLRB on August 23, 1978; <br />b) Exhibit E, concerning uranium content, of the application approved <br />by MLRB on August 23, 1978; <br />c) Exhibits D and E, concerning the mining and reclamation plans, of <br />the application approved by MLRB on August 23, 1978. <br />The facts constituting the alleged violations are: <br />A. The temporary waste pile is larger tha:l the 1.14 acres outlined in <br />the permit. <br />B. The temporary waste pile is in the wrong location as outlined in the <br />permit and is spilling into Ralston Creek. <br />C. The cutoff for the uranium content of rock to be placed in the waste <br />pile is .07 percent rather than the .015 percent which is permitted. <br /> <br />D. A ;acre unpermitted gravel pit was opened adjacent to Ralston Creek <br />with no topsoil salvage. <br />
