Box 1009 Glenwood Springs, Colorado 81602 January 10, 2001 RECEIVED JAN 1 2 2001 Uirision of Minerals and Geology Please consider this letter, which supercedes my letter of November 27, 2000, as my decision to move forwazd on processing the filing of your Plan of Operations at this time. We recognize your filing as a plan modification involving new facilities. When we receive the additional information requested below, consider this letter as accepting your plan modification as a proposed action that we can proceed with toward plan approval. These include the following: 43 CFR 3809.1-5, specifically as it relates to: *access [o and maintenance of the sediment ponds, *maintenance and stabilization of the roads, * number of acres disturbed at each stage of the operation, in addition to location. We would still like to meet with you on January 16 to discuss; 1) any clarification of the above information and 2) to discuss a Plan Approval process which includes completing an environmental document and decision, and compliance with section 106 of the National Historic Preservation Act and section 7 of the Endangered Species Act. If you are agreeable to this decision, please formally respond to the State Office rescinding your current appeal on record. Unless we hear from you [o the contrary or you have other questions before the January 16 meeting, we will see you on Tuesday at 1 pm at the Glenwood Springs Field Office. Sincerely, Anne E.
