Box 1009 <br />Glenwood Springs, Colorado 81602 <br />January 10, 2001 <br />RECEIVED <br />JAN 1 2 2001 <br />Uirision of Minerals and Geology <br />Please consider this letter, which supercedes my letter of November 27, 2000, as my <br />decision to move forwazd on processing the filing of your Plan of Operations at this time. <br />We recognize your filing as a plan modification involving new facilities. When we <br />receive the additional information requested below, consider this letter as accepting your <br />plan modification as a proposed action that we can proceed with toward plan approval. <br />These include the following: <br />43 CFR 3809.1-5, specifically as it relates to: <br />*access [o and maintenance of the sediment ponds, <br />*maintenance and stabilization of the roads, <br />* number of acres disturbed at each stage of the operation, in addition to location. <br />We would still like to meet with you on January 16 to discuss; 1) any clarification of the <br />above information and 2) to discuss a Plan Approval process which includes completing <br />an environmental document and decision, and compliance with section 106 of the <br />National Historic Preservation Act and section 7 of the Endangered Species Act. <br />If you are agreeable to this decision, please formally respond to the State Office <br />rescinding your current appeal on record. Unless we hear from you [o the contrary or <br />you have other questions before the January 16 meeting, we will see you on Tuesday at <br />1 pm at the Glenwood Springs Field Office. <br />Sincerely, <br />Anne E.
