Long <br />Somerset, CO 81434 Division Dveaor <br />RE: Portal Access Road Repair (Minor Revision-21); Bear ~3 Mine; <br />Permit No. C-81-033 <br />Dear Mr. Bear: <br />On August 21, 1996 the Division received the above referenced <br />permit revision application to repair the portal access road. The <br />application has been deemed incomplete for the purposes of filing. <br />The Division intends to approve the road repair as a minor revision <br />to the permit, however, at this time the application is considered <br />inadequate for the following reasons: <br />The Division does not agree with the permittees assertion <br />that rule 4.03.2(3) does not apply to the Bear Mine #3 <br />access road. The road is situated on ground which would <br />not be disturbed if the road did not exist. To expedite <br />approval, the Division will separate this issue from the <br />minor revision application process. Please submit to the <br />Division within 30 days an agreement in writing that the <br />conditions for design and construction of the access road <br />will be met in accordance with Rule 4.03.2(3). A revised <br />permit page 21-19 will be required. <br />2. The slope stability monitoring information included in <br />the application shows the slope to be creeping at a <br />reduced rate. Some risk still exists that the proposed <br />cutslope excavation and road surface regrading may <br />destabilize the thin slide body again. No information is <br />provided within the application with which to assess this <br />possibility. The existing condition is being monitored, <br />however, the proposed action could worsen the situation <br />and present additional stability problems. Please <br />address the possibility that the proposed cut work might <br />actually further destabilize the slide mass. <br />3. The Division is concerned about the feasibility of final <br />reclamation of the site. The repeated occurrences of <br />slope instability raises the question whether the <br />
