Mail, within one (p day after receipt of this Notice, to the Mined Land Reclamation Board, written <br />notice of your compliance with paragraph one (p of this Cease and Desist Order. <br />3. Complete the following corrective actions: <br />a. File an amendment or conversion to include all disturbed areas within the permit area (if an <br />amendment, it should be filed by February 26, 1996, if a conversion, it should be filed by <br />March 26, 1996). <br />b. file a technical revision for storing concrete and asphalt on the permit area by <br />February 26, 1996, or remove all asphalt and concrete from the permit area. <br />c. Post the increase in the bond by February 13, 1996, or reclaim permit area so reclamation <br />bond liability is equal to or less than the posted bond amount. <br />Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of $3500.00, within <br />30 days of the signature date of this document. This is based upon an assessment of $100.00 per day <br />for 65 days of violation, from November 20, 1995 to January 24, 1996, with $3000.00 suspended <br />upon completion of the corrective action outlined in this order. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are advised <br />to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain <br />time, shall be construed as a permit or license to engage in any prospecting or mining operations within the <br />State. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult C.R.S. 24-4-106, <br />as amended. <br />~~ ~ ~ <br />Dated at Denver this ~~ day of ~L'~+ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
