III IIIIIIIIIIIII III <br />999 <br />Date: October 28, 1994 <br />To: Susan McCannon <br />From: David Berry <br />Re: Notice Of Violation C-94-026 - Canadian Strip - C81-026 <br />On 9/29/94, the above-referenced NOV was issued for failure to <br />maintain the following documents at the County Courthouse <br />(designated public records storage location): <br />DMG Permit <br />Current Insurance Certificate <br />Bond Document <br />Phase I and II Bond Release documents and Findings <br />Second Quarter NPDES DMRs <br />The request to vacate the NOV received 10/24/94, makes several good <br />points; however, the bottom line is that on the day I inspected, <br />the documents were not there. The request references an OSM report <br />relative to an outdated insurance certificate.. The current <br />certificate was missing. <br />The overall impact of the situation is minimal. We did experience <br />some delay in our inspection since the historic bond release <br />information was missing, and this information had direct bearing on <br />our inspection. It was necessary to contact the consultant by <br />telephone to obtain the needed information to proceed. I believe a <br />minor violation does exist. <br />
