Dept. of Natural Resources
Mr. Greg Squire
Mined Land Reclamation Division
1313 Sherman Street
Denver, Colorado 80203
Re: Abatement Procedures for NOV C-85-004, Wyoming Fuel Company (WFC), New Elk
Mine, Permit No. C-012-81.
Dear Mr. Squire:
I am requesting a 30 day extension for partial abatement of the above notice of
violation. Nan effort to prevent unwanted thickener and wash plant discharge to ponds
006 and 007 WFC will be installing a clarified water circuit. This circuit will take clear
water from the thickener for reuse in the wash plant. The electrical and concrete work
for this circuitry is complete. The pump has been ordered and will be shipped on March 1,
1985. Considering shipping time and construction the new circuit should be in operation
by the third week in March.
During this interim period, it may be necessary to discharge thickener overflow and
totally empty the thickener. I would like to use pond 006 for this purpose. Water will be
held in this pond and discharged when NPDES effluent limitations are met. The only risk
involved in doing this would be the chance of receiving a 10 year, 24 hour storm event at
the same time the thickener was being emptied. This is a low risk during March. Sump
water from the plant will report to the thickener.
After the new circuiting is installed, it will still be necessary to empty the thickener
two (2) or three (3) times per year for maintenance. Initial calculations show the
thickener volume can be handled by distributing this volume between ponds 006 and 007.
The thickener volume represents 2.16 acre feet. The combined excess storage capacity of
ponds 006 and 007 also equals 2.16 acre feet providing a 60% sediment level is maintained
(see calculation sheets attached).
